Agreement to Terms

By downloading, installing, or using the ItemTracker mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and A2MZ Limited Company ("Company," "we," "our," or "us").

Description of Service

ItemTracker is a mobile application designed to help users track and locate infrequently accessed household items. The App provides features including:

  • Item tracking with photos and locations
  • AI-powered photo detection to add items quickly
  • Organization through collections
  • iCloud synchronization across devices
  • Sharing collections with family members
  • Voice input and Siri integration
  • Home screen widgets

Eligibility

You must be at least 13 years old to use this App independently. Children under 13 may use the App under parental supervision using a parent or guardian's iCloud account.

By using the App, you represent and warrant that you meet these eligibility requirements.

Account and iCloud

The App requires an Apple ID and iCloud account to function. You are responsible for:

  • Maintaining the security of your Apple ID and iCloud credentials.
  • All activities that occur under your account.
  • Ensuring you have sufficient iCloud storage for the App's data.

We do not control and are not responsible for Apple's iCloud service. Your use of iCloud is subject to Apple's terms of service.

Subscription and Payments

Free Trial

New users are eligible for a 30-day free trial of ItemTracker Pro. The trial provides full access to all features.

Subscription Options

After the trial period, continued access requires a paid subscription:

  • Monthly: $1.99 USD per month
  • Annual: $19.00 USD per year (equivalent to $1.58/month)

Billing

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel your subscriptions in your App Store account settings.

Refunds

Refund requests are handled by Apple according to their refund policy. We do not process refunds directly.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the App or its systems.
  • Upload or share content that is illegal, harmful, or infringes on others' rights.
  • Upload photos containing illegal, harmful, or inappropriate content through the photo detection feature.
  • Interfere with or disrupt the App or servers connected to it.
  • Reverse engineer, decompile, or disassemble the App.
  • Use automated systems to access the App without permission.

User Content

You retain ownership of all content you create within the App, including item names, descriptions, photos, and locations ("User Content").

By using the App, you grant us a limited license to process your User Content solely for the purpose of providing the App's services. We do not access, view, or use your User Content for any other purpose.

You are solely responsible for your User Content and its legality.

Photo Processing

When you use the photo detection feature, your photos are temporarily transmitted to third-party AI services (Google Vertex AI) for item identification. By using this feature, you consent to this processing. Photos are processed in real-time and immediately deleted—they are not stored by us or our service providers. You retain all rights to your photos; we only process them to extract item names for your convenience.

Third-Party Services

The App integrates with third-party services to provide certain features:

  • Apple iCloud & CloudKit: Used for data storage and synchronization. Subject to Apple's Terms of Service.
  • Google Vertex AI: Used for photo-based item detection. Photos are processed in real-time and immediately deleted. Subject to Google Cloud Terms of Service. Google does not retain your images or use them for model training.
  • Apple Intelligence: Used for on-device semantic search and calendar suggestions on supported devices. Processed entirely on your device.

We are not responsible for the practices of third-party services. We encourage you to review their respective privacy policies and terms.

Sharing and Collaboration

When you share collections with others:

  • You are responsible for who you invite and the permissions you grant.
  • Shared users may view, edit, or delete items based on the permissions you provide.
  • You can revoke access at any time.
  • We are not responsible for actions taken by users you have granted access to.

Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by A2MZ Limited Company and are protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written consent.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free.
  • The results obtained from using the App will be accurate or reliable.
  • Any errors in the App will be corrected.

AI-powered features, including photo detection and smart search, may produce inaccurate results. We do not guarantee the accuracy of item names detected from photos.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A2MZ LIMITED COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless A2MZ Limited Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:

  • Your right to use the App will immediately cease.
  • Your data will remain in your iCloud account (subject to Apple's policies).
  • No refund will be provided for unused subscription periods.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the App or by email.

Your continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which A2MZ Limited Company is registered, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
